in accepting this equipment by signing below, with Sun Rental Center, owner, customer hereby agrees:

1.the rental equipment has been received in good working condition, and will be returned in the same condition, ordinary wear and tear accepted.

2.customer agrees to pay in full for all damages or loss to rental equipment and further agrees not to loan, sublet or otherwise dispose of equipment or use it at any other location than listed above.

3.customer assumes all responsibility for injuries to persons or damages to property, and agrees to hold owner harmless for any and all claims , of whatsoever nature, arising out of use of the rental equipment while in his custody.

4.customer agrees to owner's rights to enter premises of customer at any time to repossess said equipment.  customer hereby waives any rights of action against owner by reason of such taking or entry and agrees to reimburse owner's cost of repossession if any.

5.customer agrees to reimburse owner for all attorney's fees, an amount not less than 25% of all sums due, court costs and expenses incurred by owner to enforce collection or to preserve or enforce owner's rights under this contract.  this contract shall be governed by the laws of the state of Washington, and the money due hereunder must be paid to the office indicated above is Stevens County, Washington.

Damage waiver:

damage waiver does not apply under the following conditions:

a. loss or damage as a result of theft, vandalism, or malicious mischief.

b. loss or damage to accessories such as air hose, tool steel, electric cord, blades, welding cable , liquid fuel tanks and other similar items.

c. loss caused by willful neglect, misuse or abuse.

d. unexplained loss or mysterious disappearance.

e. theft, conversion or other dishonest act on part of any person or persons to whom the issued property is entrusted or any person or persons in the service or employment of the lessee whether or not occurring during the hours of such service or employment.

f. equipment left unsecured.  equipment must be secured in a fenced area, building or locked with hi-test chain when left unattended.

g. use of equipment in violation of any terms of this agreement.
